A married insurance agent has been found guilty of entering the room of an Indonesian maid and having non-consensual sex with her on two previous occasions. In one of the incidents, the defendant was reportedly unable to maintain an erection, resulting in the act not being completed.
The agent had previously pleaded not guilty in the High Court to rape and attempted rape charges. However, the jury ruled against him, dismissing the charge of attempted rape but finding him guilty of rape. Accordingly, the defendant was sentenced to 7 years in prison.
The defendant Chow Ka-wei, 45 years old, is married with two daughters and one son. According to the rape charge, the defendant allegedly forced himself on the victim, referred to in court documents as "X," on Aug. 10, 2021. At the time of the incident, X was about 40 years old. The evidence presented by the prosecution showed that in the early morning of that day, the defendant entered X's room and declared "I want you." He began touching her breasts and attempted to force his genitals into her mouth.
Subsequently, the defendant inserted his fingers into X's private parts and had non-consensual sexual intercourse with her for 10 to 20 seconds without taking any form of contraceptive measures.
At trial, the defendant chose to present his defense and claimed that X initiated the encounter. He further claimed that he eventually agreed to have sex with her after she gave him HK$500.
However, the next day, X demanded HK$50,000 from the defendant and threatened to expose the incident to his wife if he did not comply. Defendant refused and X subsequently reported the incident to the authorities. The six-man jury reached its verdict Sept. 5 after about 11 hours of deliberations.
By a majority of 5 to 1, they found the defendant guilty of rape while unanimously excluding a charge of attempted rape.
