Customs and Excise Department announced the new regulations for precious stones and metals business

The Hong Kong Customs and Excise Department (C&ED) commenced the regulatory regime for the precious stones and metals merchants on the 1st of April, in Hong Kong. The new regime was a specified (Amendment) Ordinance 2022 in the Anti-Money Laundering and Counter-Terrorist Financing announced on 16th December, last year.

The new regulation stated that a registration will be henceforth required with the Customs and Excise Department for any Hong Kong resident merchant seeking to engage in the precious stones and metals business transactions of accumulated value, HK$120,000 or above and non-Hong Kong merchants are required to submit a cash transaction report for any cash transaction with a total value of HK$120,000 or above in Hong Kong. Such merchants also have to fulfil their Anti-Money Laundering Counter- Terrorist Financing obligations appropriately.

The merchants who were already in operation before the Regime started are allowed to apply for registration within the nine-month transitional period from now till December 2023 with the relevant fees for the first registration to be waived for them.

香港海關公佈寶石及金屬業務新規

香港海關 (C&ED) 於 4 月 1 日在香港開始對寶石和金屬商人實施監管制度。 新制度是去年 12 月 16 日公佈的《反洗錢和反恐融資條例》中的 2022 年特定（修訂）條例。

新規規定，任何香港居民商戶欲從事累計價值 120,000 港元或以上的寶石及金屬業務交易，須向海關登記，非香港商戶則須向香港海關登記。 就任何在香港進行的總值達 120,000 港元或以上的現金交易，提交現金交易報告。 此類商戶還必須適當履行其反洗錢反恐融資義務。

即日起至2023年12月的九個月過渡期內，允許在製度實施前已經營業的商戶申請註冊，並免除首次註冊的相關費用。
