Hong Kong government agreed on the proposal for tougher penalties on Uber drivers

The Hong Kong Transport and Logistics Bureau draft amendment bill was vetted and the government on Friday (3rd of November, 2023) reached the agreement to make changes concerning penalties for the illegal transport of passengers for hire or reward by motor vehicles. Frankie Yick Chi-ming, a lawmaker for the transport functional constituency, proposed the change.


According to the law in the city, ride-hailing services including Uber drivers are illegal without hire car permits.


The present law says anyone who uses a motor vehicle for the illegal transport of passengers either for hire or reward is liable to a maximum fine of HK$5,000 and imprisonment of three months. Moreover, such a person's vehicle license would be suspended and the vehicle would be impounded for three months on the first conviction.


If the person is convicted the second time, a maximum fine of HK$10,000 and imprisonment of six months may be imposed along with the suspension of vehicle license and impoundment of vehicles for six months.


However, lawmaker Yick proposed that the maximum sentence upon first conviction should be increased to six months, while subsequent convictions should see a prison sentence of up to 12 months.

香港運輸及物流局修訂法案草稿已獲審議,政府同意修改以無車輛許可證的車輛非法出租或取酬載客的處罰規定。 交通功能界別的立法會議員易志明提出了這項改變。


根據該市的法律,沒有計程車許可證,包括優步司機在內的乘車服務都是非法的。

現行法律規定,任何人使用機動車輛非法


運送乘客,無論是出租或取酬,最高可被罰款港幣 5,000 元和監禁三個月。 此外,首次定罪後,該人的車輛牌照將被吊銷,車輛將被扣押三個月。


若第二次被定罪,最高可處罰款港幣 10,000 元及監禁六個月,並可暫時吊銷車輛牌照及扣押車輛六個月。


不過,易議員建議,首次定罪的最高刑期應增加至六個月,而後續定罪則應判處最高12個月的監禁。
