Five individuals, four Filipinos and one Bangladeshi, who have been accused of indecently assaulting a young girl, have been sent back to jail. Their case has been adjourned until February 29 next year, which means they will have spent over a year in jail since their arrest.
The accused individuals are Jimwoel Macaraig (53), Julie Arcega (32), Gina Villanueva, Benjur Macaraig (46), and MD Moazzim-hossain (42). The incident allegedly took place on January 3 inside an apartment on Kung Om Road in Yuen Long.
Judge Pang Chung Ping reluctantly agreed to the defense counsel's request for a further postponement of the case. The judge emphasized the importance of expediting the trial due to the young age of the alleged victim, who is only 10 years old. However, when the prosecution was asked to respond to the adjournment request, they did not object.
The counsel for the first defendant requested the postponement, stating that they had only received a copy of the relevant video evidence on the morning of the hearing and had not had the opportunity to watch or review it. The counsel also mentioned the need to review additional documents in preparation for a potential trial.
In a previous hearing, all the defendants pleaded not guilty to the charges, claiming they were not present at the location where the alleged indecent assault occurred. It was revealed that all the individuals involved in the case were neighbors in Tuen Mun, and the parents of the girl were friends with the accused. The girl was alone in the apartment when the alleged indecent assault took place.
Furthermore, it was disclosed that one of the accused, B Macaraig, faces an additional charge of injuring the child and has a history of three previous criminal records. The prosecutor also mentioned that B Macaraig had previously jumped bail in an immigration case.
During earlier hearings at Tuen Mun Court, all the defendants applied for bail but were denied. No application for bail was renewed at the District Court.
