Marilyn Tang, the sister-in-law of Lee Cheuk-yan, the jailed veteran activist, former secretary-general of the Hong Kong Federation of Trade Unions and former chairman of the Hong Kong Alliance for Patriotic Democratic Movements in China, faces charges of obstruction of justice related to obtaining evidence in a national security case.

Tang is accused of twice removing evidence related to cases of "collusion with foreign countries or external forces to endanger national security" before law enforcement executed search warrants. Evidence included computers and phones. The case was brought up in the West Kowloon Magistrates' Court today (7th), and Tang pleaded guilty. The presiding judge pointed out that the defendant's behavior was intentional and premeditated, and that it was inevitable that he would be imprisoned. The judge ordered Tang remain jailed until sentencing on Dec. 21 while a background report is prepared.

Marilyn Tang, 63, claimed unemployment. The defense argued that Tang fully cooperated with law enforcement during the investigation and did not intentionally destroy evidence. They believed her actions were impulsive and foolish, without considering the consequences. The defense further pointed out that law enforcement was able to successfully access the contents of the computer and mobile phone afterwards and found no incriminating evidence.

They argued that the defendant's actions had no material impact. The defense acknowledged the seriousness of the charges and the need for a prison sentence, but asked the court to consider the defendant's background and remorse and adopt a lower starting point for sentencing.

The charges against Tang involve a series of acts with a tendency to obstruct justice committed in Hong Kong on March 9, 2023, with the intention of obstructing justice. These included entering a unit in Mei Foo's Sun Chuen where Tang lived before the Hong Kong Police Force executed a search warrant. Defendants deleted evidence relevant to Tang's investigation, thereby preventing the retrieval and/or interfering with evidence in this case.
